Surviving Obesity Lawsuits

Obesity lawsuits result from a wide variety of conditions. Weight management is one of the key processes in most adults minds. As our jobs and lives get more complicated and stressful we often resort to over-eating and drinking to comfort us. There is nothing new in this, what is new is that these same adults then look to others to tell them how to stop the behavior they know is not good for them.

It is most surprising that a whole medical specialty has risen up around obesity and the treatment of it. Given this and modern mans desire to always blame someone else when things go wrong, it is not surprising that the number of obesity lawsuits is on the rise. Obesity lawsuits result from two categories of issues. The first is failed and destructive surgeries and the second is the lack of weight loss that is presumably guaranteed by the program that you tried.

Failed or Destructive Surgeries

Obesity lawsuits that are resulting from problems with surgery are very rarely won by the plaintiff, unless negligence can be proved or the surgery resulted in a condition that was not fully disclosed by the surgeon before the procedure was begun. Often obesity lawsuits are considered by many who are experiencing complications with eating that result from full digestive tract modifications that staple the stomach and reduce the length of the intestines.

Unfortunately, as there are a surprising number of folks who experience such complications or perhaps even life threatening events, it is unlikely that such obesity lawsuits would result in much financial benefit to the plaintiff. For this form of surgery the chances of success and difficulties are well documented and exposed to the patient from the beginning.

However, given all of the above, there are some surgeons who respond to obesity lawsuits simply by offering a quick settlement as they do not want the adverse publicity. Folks who are considering any form of surgery should consider the legal records of their surgeon before commencing with the surgery.

Lack of Weight Loss

Today most weight management programs are very careful how they word the benefits of their programs as there are an increasing number of dissatisfied patients who are resorting to obesity lawsuits when they dont look like pictures on the doctors walls or plastered on the billboards. Obesity lawsuits in such cases can be quite complicated, as although most practices carefully word their contracts and patient rights documents, some attorneys may still proceed with the lawsuit.

The basis of these lawsuits is typically based on false advertising. Obesity lawsuits based on such terms may be quite successful. All of the weight management practices will focus on success and describe how well their patients are doing, few disclose their failures. It is indeed sad that obesity lawsuits in these cases will stress that advertising should be focused on the lowest common denominator and assume minimum individual discretion in understanding the information in front of them.
